Welcome to Eventgroove (https://products.eventgroove.com/) (the "Products Site" or "Site").

These Eventgroove Terms of Use ("Products Terms") supplement and are incorporated into the Eventgroove Terms of Use available at https://www.eventgroove.com/terms-of-use (the "General Terms"). Capitalized terms used but not defined in these Products Terms have the meanings given to them in the General Terms.

By accessing or using the Products Site or placing an order, you agree to be bound by both the General Terms and these Products Terms. In the event of any conflict between these Products Terms and the General Terms, these Products Terms shall control with respect to your use of the Products Site and purchase of Products.

PLEASE REVIEW THESE PRODUCTS TERMS CAREFULLY. THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN THE GENERAL TERMS APPLY TO ALL DISPUTES ARISING FROM YOUR USE OF THE PRODUCTS SITE OR PURCHASE OF PRODUCTS.

1. DEFINITIONS

In addition to the definitions in the General Terms, the following terms have the meanings set forth below:

  • "Customer" or "You" means any individual or entity that places an order for Products through the Site.

  • "Custom Products" means Products that are manufactured, printed, or produced according to Customer-provided specifications, designs, artwork, or other customizations.

  • "Customer Content" means any text, images, graphics, logos, artwork, designs, photographs, or other content that Customer uploads, submits, or provides to be incorporated into Products.

  • "Order" means a request to purchase Products submitted by Customer through the Site.

  • "Products" means the goods, merchandise, printed materials, and other items available for purchase on the Site, including but not limited to tickets, event badges, invitations, wristbands, postcards, t-shirts, apparel, and other print-on-demand and promotional products.

  • "Production Time" means the estimated time required to manufacture, print, or produce Products after an Order is accepted, excluding shipping time.

2. PRODUCTS AND SERVICES

2.1 Product Offerings

The Products Site offers custom print-on-demand products and merchandise including tickets, event badges, invitations, wristbands, apparel, and other promotional items. Products are manufactured to order based on Customer specifications and are not held in inventory.

2.2 Product Descriptions

We strive to provide accurate descriptions, specifications, and images of all Products. However, we do not warrant that Product descriptions, specifications, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. If a Product offered on the Site is not as described, your sole remedy is to return it in accordance with our Returns Policy.

2.3 Color Accuracy Disclaimer

IMPORTANT: Colors displayed on your screen may not accurately represent the actual printed colors. Variations in monitor calibration, display settings, ambient lighting, and other factors can cause significant differences between on-screen colors and printed results. Additionally, printing processes, paper stocks, and material substrates affect final color appearance. We do not guarantee exact color matching. If precise color accuracy is critical for your project, please contact us to request a printed proof sample before placing your full order.

2.4 Print-on-Demand Nature

All Products are produced on a print-on-demand basis. This means each item is manufactured specifically for your Order after it is placed and accepted. Due to the custom nature of these Products, they cannot be resold or restocked if returned.

3. ORDERS AND PRICING

3.1 Order Placement

By placing an Order, you are making an offer to purchase Products subject to these Products Terms. All Orders are subject to acceptance by Eventgroove. We may, in our sole discretion, refuse to accept any Order for any reason, including but not limited to: product unavailability, errors in pricing or product information, suspected fraud, or Customer Content that violates these Products Terms.

3.2 Order Confirmation

After you place an Order, you will receive an email acknowledging receipt of your Order. This acknowledgment does not constitute acceptance of your Order. Acceptance occurs when we begin production of your Products or when we ship your Order, whichever occurs first. We reserve the right to cancel any Order before acceptance.

3.3 Pricing

All prices displayed on the Site are in U.S. Dollars unless otherwise indicated. Prices are subject to change without notice. The price charged for Products will be the price in effect at the time of Order placement. Prices do not include shipping, handling, or applicable taxes, which will be added to your Order total at checkout.

3.4 Pricing Errors

If we discover a pricing error after accepting your Order but before shipment, we will notify you and give you the option to: (a) proceed with the Order at the correct price, or (b) cancel the Order for a full refund. If we cannot contact you or do not receive a response within a reasonable time, we may cancel the Order and issue a full refund.

3.5 Payment

Payment is due in full at the time of Order placement. We accept major credit cards and other payment methods as indicated on the Site. By providing payment information, you represent and warrant that you are authorized to use the payment method and that the information provided is accurate and complete.

3.6 Taxes

You are responsible for all applicable taxes associated with your Order, including sales tax, use tax, value-added tax, and any other taxes or duties. We will collect and remit taxes where required by law.

4. ORDER CANCELLATION AND MODIFICATIONS

4.1 No Cancellations After Placement

Because all Products are custom manufactured to order, Orders cannot be cancelled or modified once placed. Production typically begins promptly after Order acceptance. Please carefully review all Order details, including product specifications, quantities, shipping address, and Customer Content before completing your purchase.

4.2 Pre-Production Review

If you have questions or concerns about your Order, contact us immediately at 888.771.0809 or [email protected]. If production has not yet begun, we may, in our sole discretion, accommodate requests for changes or cancellation. Once production has started, changes and cancellations are not possible.

4.3 Proof Approval

For certain Orders, we may provide a digital proof for your review and approval before production. You are responsible for carefully reviewing the proof for accuracy, including spelling, grammar, colors, layout, and all other details. Once you approve a proof, we will proceed with production based on that approved proof. We are not responsible for errors that were present in an approved proof.

5. CUSTOMER CONTENT AND INTELLECTUAL PROPERTY

5.1 Your Ownership of Customer Content

You retain full ownership of all Customer Content that you upload or provide. Eventgroove does not claim ownership of your designs, artwork, logos, or other intellectual property.

5.2 License to Eventgroove

By submitting Customer Content, you grant Eventgroove a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, modify (for production purposes only, such as formatting, resizing, and color adjustment), and display your Customer Content solely for the purpose of: (a) producing and fulfilling your Order; (b) providing customer support related to your Order; and (c) improving our Products and services. This license terminates upon completion and delivery of your Order, except that we may retain copies as necessary for record-keeping, quality assurance, and legal compliance purposes.

5.3 Your Representations and Warranties

By submitting Customer Content, you represent and warrant that:

  • You own all rights to the Customer Content or have obtained all necessary permissions, licenses, and consents to use and authorize us to use the Customer Content as described herein

  • The Customer Content does not infringe, misappropriate, or violate any third party's intellectual property rights, rights of publicity, rights of privacy, or other legal rights

  • The Customer Content does not contain any content that is defamatory, obscene, illegal, threatening, or otherwise objectionable

  • You have obtained all necessary releases from any individuals whose name, likeness, or other identifying information appears in the Customer Content

  • The Customer Content complies with all applicable laws and regulations

5.4 Prohibited Content

You may not submit Customer Content that:

  • Infringes any copyright, trademark, patent, trade secret, or other intellectual property right

  • Contains counterfeit logos, trademarks, or brand identifications

  • Promotes hate, violence, discrimination, or illegal activities

  • Contains sexually explicit, pornographic, or obscene material

  • Exploits minors or contains child sexual abuse material

  • Contains false, misleading, or deceptive content

  • Violates any applicable law or regulation

5.5 Right to Refuse

We reserve the right to refuse to produce any Order containing Customer Content that, in our sole judgment, violates these Products Terms, infringes third-party rights, or is otherwise objectionable. If we refuse an Order for this reason, we will notify you and issue a refund for that Order.

6. PRODUCTION AND FULFILLMENT

6.1 Production Times

Estimated Production Times are displayed on each product page and represent the typical time required to manufacture your Products after Order acceptance. Production Times are estimates only and are not guaranteed. Actual production time may vary based on product complexity, order volume, material availability, and other factors.

6.2 Fulfillment Partners

Some Products may be manufactured and/or shipped by third-party fulfillment partners on our behalf. Regardless of which party produces or ships your Products, Eventgroove remains responsible for ensuring your Order meets our quality standards and these Products Terms.

6.3 Order Splitting

Orders containing multiple Products may be split and shipped separately. You will not be charged additional shipping for split shipments unless you specifically request expedited or special shipping for individual packages.

7. SHIPPING AND DELIVERY

7.1 Shipping Locations

We ship Products to addresses within the United States, Canada, and select international destinations. Shipping availability and costs vary by destination. International shipments may be subject to customs duties, import taxes, and other fees imposed by the destination country, which are the sole responsibility of the Customer.

7.2 Shipping Methods and Costs

Available shipping methods and associated costs are displayed at checkout. Shipping costs are calculated based on the shipping destination, package weight and dimensions, and selected shipping speed. Expedited and express shipping options may be available for an additional charge.

7.3 Delivery Estimates

Delivery dates and times provided at checkout are estimates only and are not guaranteed. Total delivery time equals Production Time plus shipping transit time. Actual delivery may be affected by carrier delays, weather, customs processing, incorrect addresses, and other factors beyond our control.

7.4 Risk of Loss

Risk of loss and title for Products passes to you upon delivery to the carrier. We are not responsible for delays, loss, or damage that occurs after Products are delivered to the shipping carrier. However, if your Products are lost or damaged in transit, please contact us and we will work with the carrier to resolve the issue and, where appropriate, provide a replacement or refund.

7.5 Shipping Address Accuracy

You are responsible for providing accurate and complete shipping information. We are not responsible for Orders that are delayed, lost, or returned due to incorrect or incomplete addresses provided by you. If an Order is returned to us due to an incorrect address, you may be charged additional shipping fees to reship the Order.

8. RETURNS, REFUNDS, AND REPLACEMENTS

8.1 Returns Policy

Our Returns Policy is available at https://products.eventgroove.com//returns-policy/ and is incorporated into these Products Terms by reference. Please review the Returns Policy carefully before placing an Order.

8.2 Satisfaction Guarantee

We stand behind the quality of our Products. If there is an issue with your Order due to printing problems, product defects, damaged items, wrong products shipped, or missing items, we will provide a free replacement or full refund at our discretion. Quality-related issues must be reported within thirty (30) days of receiving your Order.

8.3 Custom Product Limitations

Because all Products are custom manufactured to your specifications, we cannot accept returns for:

  • Change of mind or buyer's remorse

  • Ordering the wrong product, size, quantity, or specifications

  • Color variations that fall within normal printing tolerances or result from monitor calibration differences

  • Wanting to modify your design after production

8.4 Refund Processing

Approved refunds will be processed within five to seven (5-7) business days and credited to the original payment method. The time for the refund to appear in your account depends on your payment provider.

8.5 Replacement Processing

Approved replacements are typically produced and shipped within two to five (2-5) business days. For quality issues, you may choose to either return the defective items (we will provide a prepaid shipping label) or dispose of them responsibly without returning.

9. PRODUCT WARRANTY DISCLAIMER

EXCEPT FOR OUR SATISFACTION GUARANTEE DESCRIBED IN SECTION 8, ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that: (a) Products will meet your specific requirements or expectations beyond what is described in the product specifications; (b) Products will be free from minor variations, imperfections, or inconsistencies inherent in the printing or manufacturing process; (c) colors will exactly match on-screen displays or previous orders; or (d) Products will be suitable for any particular purpose not expressly stated in the product description.

10. LIMITATION OF LIABILITY

The limitations of liability in the General Terms apply to the Products Site and all Product purchases. Without limiting those provisions:

  • Our total liability for any Order shall not exceed the total amount paid by you for that Order

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of Products

  • We are not liable for delays in production or delivery beyond our reasonable control

  • We are not liable for any damages resulting from your use of Customer Content that infringes third-party rights

11. INDEMNIFICATION

In addition to the indemnification obligations in the General Terms, you agree to indemnify, defend, and hold harmless Eventgroove and its affiliates and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your Customer Content, including any claims that your Customer Content infringes or violates any third party's intellectual property, publicity, privacy, or other rights; (b) your breach of the representations and warranties in Section 5; (c) your use of Products in violation of applicable law; and (d) any third-party claims arising from Products manufactured using your Customer Content.

12. EXPORT COMPLIANCE

You agree to comply with all applicable export laws and regulations. You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to comprehensive U.S. sanctions, and that you are not a Specifically Designated National (SDN) or otherwise prohibited from receiving Products under U.S. law.

13. PRIVACY AND DATA COLLECTION

Our collection, use, and disclosure of your personal information in connection with the Products Site and your Orders is governed by the Eventgroove Privacy Policy available at https://www.eventgroove.com/privacy-policy and, where applicable, the Products Site Privacy Policy at https://products.eventgroove.com//privacy-policy. The Data Protection and Privacy Compliance provisions of the General Terms (Section 13) apply to your use of the Products Site.

14. ELECTRONIC COMMUNICATIONS

By placing an Order, you consent to receive electronic communications from us regarding your Order, including order confirmations, shipping notifications, delivery updates, and customer service communications. The Electronic Communications and Consent provisions of the General Terms (Section 14) apply to your use of the Products Site.

15. BUSINESS CUSTOMERS

If you are purchasing Products on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Products Terms and that the entity agrees to be bound by these Products Terms. References to "you" in these Products Terms shall include the entity on whose behalf you are acting.

16. RESALE AND COMMERCIAL USE

You may purchase Products for resale or commercial use, provided that: (a) you have all necessary rights to any Customer Content used in such Products; (b) you comply with all applicable laws regarding resale, including tax collection and consumer protection laws; and (c) you do not misrepresent Eventgroove as the manufacturer or source of such Products in a manner that could create confusion about our involvement or endorsement.

17. FORCE MAJEURE

The Force Majeure provisions of the General Terms (Section 21) apply to the Products Site and all Orders. We are not liable for delays in production or delivery caused by events beyond our reasonable control, including natural disasters, pandemics, labor disputes, supply chain disruptions, carrier delays, or government actions.

18. DISPUTE RESOLUTION

All disputes arising from or relating to these Products Terms, the Products Site, or your purchase of Products are subject to the Dispute Resolution, Arbitration, and Class Action Waiver provisions of the General Terms (Section 22). Please review those provisions carefully as they affect your legal rights.

19. MODIFICATIONS TO THESE PRODUCTS TERMS

We may modify these Products Terms at any time by posting the revised version on the Site. Changes are effective immediately upon posting. Your placement of an Order after changes are posted constitutes acceptance of the modified Products Terms. We encourage you to review these Products Terms periodically.
